("PostHive," "we," "us," or "our") through the PostHive platform (the "Service") are intended for general social media management, content scheduling, analytics, communication management, and related business productivity purposes only.

While we strive to provide accurate, reliable, and up-to-date tools and features, PostHive makes NO representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, availability, or fitness for a particular purpose of the Service, its features, the information provided through the Service, or any related graphics, content, or materials. Any reliance you place on the Service and its output is strictly at your own risk.

This Disclaimer supplements and should be read in conjunction with our Terms of Service and Privacy Policy. In the event of a conflict between this Disclaimer and the Terms of Service, the Terms of Service shall prevail.

2. No Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POSTHIVE SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, PostHive does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate, reliable, or complete.
  • The quality of any features, information, or materials obtained through the Service will meet your expectations.
  • Any errors in the Service will be corrected.
  • The Service will be compatible with all devices, browsers, or operating systems.
  • The Service will continue to be available in its current form or at all.

3. Social Media Platforms

PostHive integrates with various third-party social media platforms including, but not limited to, Facebook, Instagram, Twitter/X, LinkedIn, TikTok, YouTube, Pinterest, Threads, Discord, Reddit, and Bluesky. With respect to these integrations:

  • No Affiliation: PostHive is NOT affiliated with, endorsed by, or officially connected to any of these social media platforms. All platform names, logos, and trademarks are the property of their respective owners.
  • Platform Actions: PostHive is NOT responsible for any actions taken by social media platforms against your accounts, including but not limited to: account suspensions, temporary or permanent bans, shadow bans, content removals, reach limitations, content de-prioritization, advertising restrictions, API access revocations, or any other punitive or restrictive actions.
  • Platform Changes: Social media platforms frequently change their APIs, algorithms, policies, terms of service, and community guidelines. These changes may affect PostHive's functionality, your content reach, engagement metrics, or the availability of certain features. PostHive is NOT responsible for any negative impact resulting from such changes.
  • Rate Limiting: Social media platforms impose rate limits on API usage. PostHive operates within these limits, but rate limiting may affect the speed or timing of publishing, analytics retrieval, or other operations. PostHive is NOT responsible for delays caused by platform rate limits.
  • Platform Compliance: You are solely responsible for ensuring that your content and your use of PostHive complies with the terms of service, community guidelines, advertising policies, and other rules of each social media platform you connect.
  • Account Security: While PostHive uses secure OAuth connections, compromises at the social media platform level are beyond our control. PostHive is NOT responsible for unauthorized access to your social media accounts that does not originate from our systems.

4. AI-Generated Content

IMPORTANT: AI-generated content is provided as suggestions only. You bear sole and complete responsibility for reviewing, verifying, editing, and approving any AI-generated content before publishing or distributing it.

Regarding AI features, PostHive expressly disclaims liability for:

  • Accuracy: AI-generated content may contain factual errors, inaccuracies, outdated information, fabricated information ("hallucinations"), or misleading statements. PostHive does NOT verify the factual accuracy of AI-generated content.
  • Originality: AI-generated content may inadvertently resemble or reproduce existing copyrighted material, trademarks, or other protected content. PostHive does NOT guarantee the originality or non-infringement of AI-generated content.
  • Appropriateness: AI-generated content may be inappropriate, offensive, insensitive, biased, or unsuitable for your intended audience, brand, industry, or context. PostHive does NOT guarantee the appropriateness of AI output.
  • Legal Compliance: AI-generated content may violate advertising laws, consumer protection laws, industry regulations, platform-specific rules, or other applicable laws. YOU are responsible for ensuring legal compliance of all content you publish.
  • Defamation: AI-generated content may contain false statements that could be considered defamatory. PostHive is NOT responsible for defamatory content generated by AI that you choose to publish.
  • Intellectual Property Infringement: AI output may inadvertently infringe on third-party copyrights, trademarks, or other IP rights. YOU assume all liability for IP infringement claims arising from AI content you publish.
  • Brand Safety: AI-generated content may not align with your brand voice, values, or guidelines. You must review all AI content for brand consistency before publishing.
  • Performance: There is no guarantee that AI-generated content will perform better than manually created content in terms of engagement, reach, conversions, or any other metric.
  • Availability: AI features depend on third-party AI service providers and may be temporarily unavailable, slow, or produce degraded results due to factors beyond our control.

5. Analytics & Reporting

Analytics data, insights, reports, and metrics provided by PostHive are subject to the following limitations:

  • Data Source: Analytics data is retrieved from connected social media platforms via their APIs. PostHive does NOT independently verify or validate this data. The accuracy, completeness, and timeliness of analytics data depends entirely on what the respective platforms provide.
  • Delays & Discrepancies: Analytics data may be subject to delays of minutes, hours, or even days depending on the platform. Numbers shown in PostHive may differ from numbers shown directly on the social media platform due to timing differences, data processing delays, API limitations, or rounding.
  • Historical Data: Some platforms limit how far back analytics data is available via API. PostHive cannot provide analytics data that the platform does not make available.
  • Metric Definitions: Different social media platforms define metrics differently (e.g., "impressions," "reach," "engagement" may have different definitions on different platforms). PostHive displays metrics as provided by each platform and does NOT guarantee consistent metric definitions across platforms.
  • Algorithm Changes: Social media platform algorithm changes may affect reported metrics in ways that are beyond our control and may not be reflected in PostHive's analytics.
  • Informational Purposes Only: All analytics data is provided for informational purposes only and should NOT be the sole basis for business decisions, financial projections, advertising spend, personnel decisions, or other consequential actions.
  • PDF Reports: PDF reports generated by PostHive are based on the analytics data available at the time of generation and are subject to all the same limitations described above.

6. Scheduled Posts & Publishing

IMPORTANT: PostHive does NOT guarantee that scheduled posts will be published successfully. Multiple factors beyond our control can prevent or delay publication.

Scheduled posts may fail or be delayed due to:

  • Platform Outages: The target social media platform may be experiencing downtime, maintenance, or technical issues.
  • API Limitations: The platform may have changed its API, imposed new rate limits, or deprecated endpoints that PostHive relies on.
  • Token Expiration: Your OAuth access token for a connected account may have expired, been revoked, or become invalid. Some platforms require periodic re-authorization.
  • Content Policy Violations: The platform may reject your content for violating its content policies, even if PostHive successfully submits it.
  • Media Processing: Media files (images, videos) may fail to process, may be too large, or may be in an unsupported format for the target platform.
  • Network Issues: Internet connectivity issues between our servers and the target platform may prevent publishing.
  • Service Outages: PostHive's own infrastructure (servers, databases, job queues) may experience temporary outages.
  • Timing Accuracy: While we aim to publish at the scheduled time, posts may be published within a few minutes of the scheduled time due to queue processing and API delays.

Recommendations:

  • Do not rely solely on PostHive for time-critical posts (e.g., live event announcements, flash sales).
  • Monitor your scheduled posts and check their status in the PostHive dashboard.
  • Keep your connected account authorizations current and re-authorize when prompted.
  • Have a contingency plan for critical posts — be prepared to publish manually if needed.

7. Email Hub

The Email Hub feature is a convenience tool for centralized email management and is subject to the following disclaimers:

  • Not a Replacement: Email Hub is NOT a replacement for your email provider (Gmail, Outlook, etc.). It is a supplementary management interface.
  • No Delivery Guarantee: PostHive does NOT guarantee email delivery, receipt, or that emails will not be marked as spam by recipients' email providers.
  • No Storage Guarantee: Email data displayed in Email Hub is sourced from your email provider. PostHive does NOT permanently store your complete email archive.
  • Email Provider Changes: Changes to Gmail, Outlook, or other email provider APIs, policies, or security requirements may affect Email Hub functionality. PostHive is NOT responsible for feature disruptions caused by email provider changes.
  • Email Content: PostHive is NOT responsible for the content, accuracy, or legality of emails you send, receive, or manage through Email Hub.
  • Anti-Spam Compliance: You are solely responsible for ensuring your email activities comply with CAN-SPAM Act, GDPR, CASL, and other applicable anti-spam and data protection laws.
  • Email Categorization: Automated email categorization and intelligence features are suggestions only and may not be 100% accurate. You should verify categorizations and prioritizations.

8. Chat Hub & Messaging

The Chat Hub (unified messaging inbox) feature is subject to the following disclaimers:

  • Message Delivery: PostHive is NOT responsible for message delivery failures, delays, or message loss on any connected messaging platform.
  • Real-Time Limitations: While we strive for real-time message synchronization, there may be delays in message retrieval depending on platform API refresh rates and rate limits.
  • Message Accuracy: Messages displayed in Chat Hub are retrieved from connected platforms. Formatting, media, or special characters may not render identically to how they appear on the native platform.
  • Platform Restrictions: Some messaging features may be limited or unavailable depending on the connected platform's API capabilities and restrictions.
  • Message Content: You are solely responsible for the content of messages you send through Chat Hub. PostHive is NOT responsible for any claims, damages, or liabilities arising from your messages.

9. Not Professional Advice

PostHive does NOT provide professional marketing, legal, financial, tax, accounting, business, medical, or any other professional advice.

Specifically:

  • Marketing Recommendations: Optimal posting times, hashtag suggestions, content recommendations, audience insights, and engagement strategies are algorithmic suggestions based on available data. They do NOT constitute professional marketing advice and may not be effective for your specific situation, industry, audience, or goals.
  • Business Decisions: Do NOT make significant business decisions (hiring, firing, budget allocation, strategy pivots, partnership decisions) based solely on PostHive analytics, recommendations, or AI-generated insights.
  • Legal Compliance: PostHive does NOT advise on legal compliance matters. You are responsible for ensuring your social media activities, content, advertising, and data collection practices comply with all applicable laws and regulations (including but not limited to FTC guidelines, GDPR, CCPA, CAN-SPAM, advertising disclosure requirements, and industry-specific regulations).
  • Financial Projections: Any engagement metrics, ROI calculations, or performance data should NOT be used as the sole basis for financial projections or investment decisions.
  • Consult Professionals: We strongly recommend consulting with qualified marketing professionals, attorneys, accountants, and other relevant experts for specific business, legal, and financial decisions.

10. Content Ownership & Responsibility

  • You retain all ownership rights to content you create and publish through PostHive.
  • PostHive does NOT claim ownership over your content.
  • By using the Service, you grant us a limited license to process, store, transmit, and display your content solely for the purpose of providing the Service (as detailed in our Terms of Service).
  • YOU are solely responsible for all content you create, schedule, publish, or distribute through PostHive, including its legality, accuracy, appropriateness, intellectual property status, and compliance with applicable laws and platform rules.
  • PostHive does NOT review, approve, vet, or endorse user content prior to publication. Content moderation, if any, is your responsibility.
  • If your content causes harm, legal liability, platform sanctions, or any other negative consequences, you bear sole responsibility.

11. Third-Party Integrations

PostHive relies on various third-party services to provide its functionality. PostHive is NOT responsible for:

  • The availability, reliability, accuracy, or security of any third-party service.
  • Changes to third-party APIs, terms of service, pricing, or policies.
  • Data loss, corruption, or unauthorized access that occurs within third-party systems.
  • Actions taken by third-party services (e.g., account suspensions, content removals, payment processing failures).
  • Interruptions or degradation of PostHive features caused by third-party service issues.
  • Privacy practices of third-party services — each third-party service has its own privacy policy which you should review.

Third-party services PostHive depends on include (but are not limited to): social media platforms, Firebase (authentication), MongoDB Atlas (database), Redis (caching), Cloudinary (media), Lemon Squeezy (payments), Groq (AI), Resend (email), DigitalOcean (infrastructure), and Vercel (hosting).

12. API Changes & Platform Policies

Social media platforms and other integrated services may change their APIs, policies, or services at any time. These changes may result in:

  • Loss of certain PostHive features or functionality.
  • Changes in how analytics data is reported or displayed.
  • Inability to publish to certain platforms or account types.
  • Changes in available permissions or data access scopes.
  • Requirements for re-authorization of connected accounts.
  • Changes in rate limits that affect publishing speed or analytics retrieval.

PostHive will make reasonable efforts to adapt to API changes, but we cannot guarantee immediate compatibility or uninterrupted service when third-party platforms make changes. PostHive is NOT liable for any losses resulting from third-party API changes.

13. Data Accuracy & Loss

  • Data Accuracy: While we implement measures to ensure data integrity, PostHive does NOT guarantee the accuracy, completeness, or timeliness of any data stored, displayed, or processed through the Service.
  • Data Loss: Despite our backup and redundancy measures, data loss may occur due to system failures, software bugs, third-party service outages, cyberattacks, or other unforeseen events. PostHive is NOT liable for data loss.
  • Backup Responsibility: You are responsible for maintaining your own backups of critical content, data, and configurations. We recommend regularly exporting your data.
  • Data Recovery: While we maintain database backups, we cannot guarantee the ability to recover specific data points or restore data to a specific point in time.
  • Cross-Platform Data: Data imported from connected platforms is subject to the accuracy and availability of data from those platforms. PostHive cannot improve upon the quality of data provided by third-party platforms.

14. Service Availability

PostHive strives to maintain high availability but expressly disclaims any guarantee of uninterrupted service. The Service may be temporarily or permanently unavailable due to:

  • Scheduled maintenance (we will attempt to provide advance notice)
  • Emergency maintenance and critical security patches
  • Infrastructure provider outages (DigitalOcean, Vercel, etc.)
  • Database or caching service failures
  • DDoS attacks or other cybersecurity incidents
  • Network or DNS failures
  • Force majeure events (natural disasters, pandemics, etc.)
  • Service discontinuation (with reasonable advance notice)

PostHive is NOT liable for any losses, damages, missed opportunities, or other consequences resulting from service unavailability or interruptions, regardless of cause.

15. Security

While PostHive implements industry-standard security measures (encryption, access controls, monitoring, secure development practices), we expressly disclaim any guarantee that:

  • The Service is impervious to cyberattacks, data breaches, or unauthorized access.
  • Your data cannot be intercepted, accessed, stolen, or compromised by malicious actors.
  • Security vulnerabilities will not exist in the Service or its dependencies.
  • Third-party services we depend on will maintain adequate security.

You are responsible for maintaining the security of your own account (strong passwords, MFA, not sharing credentials) and your own systems (up-to-date browsers, secure networks). PostHive is NOT liable for security breaches resulting from your failure to maintain account security.

16. No Guarantee of Results

POSTHIVE MAKES NO GUARANTEE OF ANY SPECIFIC RESULTS FROM USING THE SERVICE.

Specifically, PostHive does NOT guarantee:

  • Increased social media followers, engagement, reach, impressions, or any other metric.
  • Increased website traffic, leads, conversions, sales, or revenue.
  • Improved brand awareness, reputation, or market position.
  • Return on investment (ROI) from social media activities managed through PostHive.
  • That your social media strategy will be successful.
  • That content (including AI-generated content) will perform well on any platform.
  • Time savings or productivity improvements of any specific amount.

Social media performance depends on numerous factors beyond PostHive's control, including but not limited to: content quality, audience relevance, platform algorithms, market conditions, competition, timing, industry trends, and platform-specific factors. Past performance metrics do not guarantee future results.

17. URL Shortener

PostHive's URL shortening feature is subject to the following disclaimers:

  • PostHive is NOT responsible for the content or availability of destination URLs.
  • Shortened URLs may be flagged or blocked by social media platforms, email providers, or security software.
  • Click tracking data is approximate and may not capture all clicks (e.g., due to ad blockers, privacy tools, or caching).
  • PostHive reserves the right to disable shortened URLs that point to malicious, illegal, or harmful content.
  • Shortened URLs may become unavailable if the Service is discontinued or if your account is terminated.

18. Media & File Processing

  • Media files (images, videos, documents) uploaded to PostHive may be processed, resized, compressed, or converted to ensure compatibility with various social media platforms.
  • PostHive does NOT guarantee that media will be displayed identically across all platforms.
  • Media processing may result in quality changes (compression artifacts, resolution changes, color shifts).
  • PostHive is NOT responsible for media files that are rejected by target platforms due to format, size, quality, or content policy violations.
  • You are responsible for ensuring you have the rights and licenses to use any media files you upload.
  • PostHive is NOT a permanent media storage solution. Maintain your own backups of original media files.

19. Beta & Experimental Features

From time to time, PostHive may offer beta, preview, early access, or experimental features. These features are provided WITHOUT ANY WARRANTY WHATSOEVER and may be:

  • Unstable, incomplete, or contain known bugs.
  • Modified significantly or removed without notice.
  • Inconsistent with documentation or expected behavior.
  • Cause data loss, corruption, or other unexpected behavior.

Use beta features at your own risk. Do NOT rely on beta features for critical business operations or production workflows.

20. Regulatory Compliance

PostHive provides tools for managing social media and communications. However:

  • Advertising Regulations: You are solely responsible for complying with all applicable advertising laws and regulations, including FTC disclosure requirements, ASA rules, and equivalent regulations in your jurisdiction.
  • Industry-Specific Regulations: If you operate in a regulated industry (healthcare, finance, legal, alcohol, cannabis, gambling, etc.), you are solely responsible for ensuring your social media activities comply with all industry-specific regulations.
  • Data Protection: You are responsible for your compliance with GDPR, CCPA, LGPD, and other data protection laws in connection with the data you collect and process through your social media activities.
  • Accessibility: You are responsible for ensuring your published content meets applicable accessibility requirements.
  • Local Laws: You are responsible for compliance with all local, state, national, and international laws applicable to your use of the Service and your social media activities.

PostHive does NOT provide regulatory compliance advice and is NOT liable for your non-compliance with any applicable law or regulation.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTHIVE, INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
  • LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, BUSINESS OPPORTUNITIES, OR ANTICIPATED SAVINGS.
  • COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.
  • DAMAGES ARISING FROM SOCIAL MEDIA ACCOUNT ACTIONS (SUSPENSIONS, BANS, REACH REDUCTIONS).
  • DAMAGES ARISING FROM FAILED OR DELAYED SCHEDULED POSTS.
  • DAMAGES ARISING FROM INACCURATE ANALYTICS DATA OR AI-GENERATED CONTENT.
  • DAMAGES ARISING FROM THIRD-PARTY SERVICE FAILURES OR CHANGES.
  • DAMAGES ARISING FROM DATA LOSS OR SECURITY BREACHES.
  • ANY OTHER DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, WARRANTY, STRICT LIABILITY, OR OTHERWISE), EVEN IF POSTHIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL POSTHIVE'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNTS ACTUALLY PAID BY YOU TO POSTHIVE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions may not apply, and you may have additional rights.

22. Assumption of Risk

By using PostHive, you acknowledge and agree that:

  • You understand the inherent risks of managing social media accounts through a third-party platform.
  • You understand that social media platforms may take adverse actions against your accounts for any reason.
  • You understand that scheduled posts may fail and that analytics data may be inaccurate.
  • You understand that AI-generated content may be inaccurate, inappropriate, or infringing.
  • You voluntarily assume all risks associated with using the Service.
  • You have read, understood, and agreed to this Disclaimer, the Terms of Service, and the Privacy Policy in their entirety.

23. Changes to This Disclaimer

We reserve the right to update this Disclaimer at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through email and/or a prominent notice within the Service. Your continued use of PostHive after changes are posted constitutes your acceptance of the revised Disclaimer.
