1. Acceptance of Terms
Welcome to PostHive. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and PostHive, Inc. ("PostHive," "we," "us," "our") governing your access to and use of the PostHive platform, including the website at post-hive.com, all associated applications, APIs, and services (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICE AND MUST IMMEDIATELY CEASE ALL USE.
If you are using the Service on behalf of an organization, company, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.
2. Eligibility
You must meet the following requirements to use the Service:
- You must be at least 16 years of age (or the minimum age required in your jurisdiction to enter into a binding contract).
- You must have the legal capacity to enter into a binding agreement.
- You must not be prohibited from using the Service under applicable laws.
- You must not have been previously suspended or removed from the Service for violation of these Terms.
- If acting on behalf of an organization, you must have the authority to bind that organization to these Terms.
3. Accounts & Registration
3.1 Account Creation
To access most features of the Service, you must create an account. When creating your account, you agree to provide accurate, current, and complete information. You must keep your account information updated at all times.
3.2 Account Security
- You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any authentication tokens.
- You are responsible for all activities that occur under your account, whether or not authorized by you.
- You must immediately notify us at security@post-hive.com of any unauthorized use of your account or any other breach of security.
- We strongly recommend enabling multi-factor authentication (MFA) where available.
- We will not be liable for any loss or damage arising from your failure to maintain the security of your account.
3.3 Account Restrictions
- You may not create more than one account per individual, unless expressly authorized.
- You may not share your account credentials with any third party.
- You may not use another person's account without their permission.
- You may not create an account using a false identity or information, or on behalf of someone other than yourself without proper authorization.
4. Organizations & Teams
4.1 Organization Accounts
The Service supports multi-tenant Organization accounts that allow multiple users to collaborate. The Organization administrator ("Admin") is responsible for managing Organization settings, members, roles, and permissions.
4.2 Admin Responsibilities
- The Admin is responsible for ensuring all Organization members comply with these Terms.
- The Admin controls role-based access, team structures, project permissions, and connected account access within the Organization.
- The Admin is responsible for managing billing and subscription for the Organization.
- The Admin is responsible for removing members who leave the organization and revoking their access.
4.3 Team Member Obligations
- Team members must comply with both these Terms and any internal policies set by their Organization Admin.
- Content created within an Organization may be accessible to other Organization members as determined by the Admin's permission settings.
- Upon leaving an Organization, your access to Organization data will be revoked. Content you created within the Organization may be retained by the Organization.
5. Service Description
PostHive is a social media management platform that provides the following features (subject to your subscription plan):
- Social Media Management: Content creation, scheduling, publishing, and management across multiple social media platforms.
- Analytics & Reporting: Performance analytics, audience insights, content performance metrics, and customizable reports.
- Email Hub: Centralized email management for connected Gmail and Outlook accounts.
- Chat Hub: Unified inbox for social media messages and direct messages.
- AI Content Tools: AI-powered content generation, optimization suggestions, and intelligent recommendations.
- Team Collaboration: Multi-user workspaces with role-based access control, approval workflows, and team management.
- Media Studio: Image and media management, editing, and organization tools.
- URL Shortener: Link shortening and click tracking.
- Workflow Automation: Automated content workflows, scheduling rules, and triggers.
Features may vary by subscription plan. We reserve the right to modify, add, or remove features at any time with reasonable notice.
7. Email Hub Terms
The Email Hub feature is subject to the following additional terms:
- You must be the authorized owner or have explicit permission to access any email account you connect to Email Hub.
- PostHive accesses your email data solely for the purpose of providing the Email Hub functionality (viewing, organizing, and managing emails within PostHive).
- PostHive does NOT use your email content for advertising, marketing, or any purpose unrelated to the Email Hub feature.
- PostHive does NOT permanently store your complete email data. Email content is cached temporarily for performance.
- You are solely responsible for the content of emails you send through Email Hub.
- Email Hub is a convenience tool for email management and is NOT a substitute for your email provider. PostHive does not guarantee delivery, receipt, or storage of emails.
- PostHive is not responsible for email content that is lost, delayed, intercepted, or corrupted during transmission.
- By connecting your email account, you consent to PostHive accessing your email data in accordance with our Privacy Policy and the terms of your email provider.
8. AI Features Terms
PostHive's AI-powered features are subject to the following additional terms:
- AI Content is Suggestions Only: All AI-generated content (posts, captions, hashtags, recommendations, insights) is provided as suggestions. You are solely responsible for reviewing, editing, verifying, and approving all AI-generated content before publishing or distributing it.
- No Guarantees: PostHive does NOT guarantee the accuracy, completeness, originality, legality, non-infringement, appropriateness, or factual correctness of AI-generated content. AI may produce inaccurate, biased, misleading, or factually incorrect output.
- User Responsibility: YOU assume all liability for any AI-generated content that you choose to publish, distribute, or act upon. This includes liability for defamation, copyright infringement, trademark infringement, false advertising, misleading claims, regulatory violations, and any other legal consequences.
- No Professional Advice: AI-generated insights, analytics interpretations, and recommendations do NOT constitute professional marketing, legal, financial, business, or other professional advice.
- Content Review Obligation: You must review all AI-generated content for accuracy, appropriateness, compliance with applicable laws, and compliance with the terms of any social media platform before publishing.
- Third-Party AI Providers: AI features may use third-party AI services. Your use of AI features is also subject to the applicable terms of those third-party providers.
- No Ownership Claims: PostHive does not claim ownership of AI-generated content created at your direction. However, AI-generated content may not be protectable by copyright in all jurisdictions.
- Prohibited AI Uses: You may not use AI features to generate content that is illegal, harmful, deceptive, discriminatory, sexually explicit, violent, or that violates any third party's rights.
9. Content & User Responsibilities
9.1 Your Content
You retain all ownership rights to content you create and upload to PostHive ("User Content"). By uploading, posting, or transmitting User Content through the Service, you grant PostHive a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content solely in connection with providing and improving the Service.
This license is limited to:
- Transmitting your content to connected social media platforms at your direction
- Storing your content for scheduling and draft purposes
- Displaying your content within the PostHive dashboard
- Processing your content for analytics and reporting features
- Creating thumbnails, previews, and optimized versions for display within the Service
This license terminates when you delete your User Content from the Service or when your account is terminated, except to the extent that content has already been published to third-party platforms or shared with other Organization members.
9.2 Content Representations & Warranties
By posting User Content, you represent and warrant that:
- You own or have the necessary licenses, rights, consents, and permissions to use and authorize PostHive to use your User Content as described in these Terms.
- Your User Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or other rights.
- Your User Content does not violate any applicable law, regulation, or third-party terms of service.
- Your User Content does not contain defamatory, obscene, pornographic, abusive, or otherwise objectionable material.
- Your User Content does not contain viruses, malware, or other harmful code.
9.3 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, objectionable, or otherwise inappropriate. We are under no obligation to monitor User Content but may do so at our discretion.
10. Acceptable Use Policy
You agree NOT to use the Service to:
10.1 Prohibited Content
- Publish, distribute, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or discriminatory.
- Publish content that promotes violence, terrorism, self-harm, or illegal activities.
- Publish sexually explicit content involving minors.
- Publish content that infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.
- Publish misleading, fraudulent, or deceptive content.
- Publish unsolicited or unauthorized advertising, spam, or promotional materials.
10.2 Prohibited Activities
- Attempt to gain unauthorized access to the Service, other user accounts, or any systems or networks connected to the Service.
- Use the Service to engage in any form of automated data collection (scraping, data mining, data extraction) except through authorized API access.
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
- Introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material.
- Use the Service to send spam, bulk unsolicited messages, or engage in any form of fraudulent engagement (fake likes, fake followers, etc.).
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Use the Service to circumvent rate limits, usage limits, or other restrictions imposed by social media platforms.
- Resell, sublicense, lease, or otherwise redistribute the Service without our prior written consent.
- Use the Service in any manner that could damage, disable, overburden, or impair the Service.
- Impersonate or attempt to impersonate PostHive, a PostHive employee, another user, or any other person or entity.
- Use any robot, spider, crawler, or other automated device to access the Service for any purpose without our prior written consent.
10.3 Enforcement
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, at our sole discretion, without prior notice or refund. We may also take legal action if warranted.
11. Intellectual Property
11.1 PostHive IP
The Service and its entire contents, features, and functionality — including but not limited to all software, code, algorithms, text, displays, images, video, audio, design, the selection and arrangement thereof, trademarks, service marks, trade names, logos, and trade dress — are owned by PostHive, Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
11.2 Limited License
Subject to your compliance with these Terms, PostHive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your internal business purposes during the term of your subscription.
11.3 Restrictions
You may not:
- Copy, modify, or create derivative works of the Service or any part thereof.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Use PostHive's name, logo, or branding without prior written consent.
- Frame or mirror the Service or any portion thereof.
11.4 Feedback
If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant PostHive an irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and incorporate such Feedback into the Service without obligation to you.
12. DMCA & Copyright Infringement
We respect intellectual property rights. If you believe that any content on the Service infringes your copyright, please submit a DMCA takedown notice to our designated agent with the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and that is to be removed, and information reasonably sufficient to permit us to locate the material.
- Your contact information (address, telephone number, and email address).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act. Repeat infringers may have their accounts terminated.
13. Subscription & Billing
13.1 Subscription Plans
The Service offers various subscription plans with different features, limits, and pricing. The features and limits of each plan are described on our pricing page and may change from time to time. Current plan details and pricing are available at our website.
13.2 Billing
- Subscriptions are billed in advance on a recurring basis (monthly or annually), depending on the plan you select.
- All payments are processed through our third-party payment processor (currently Lemon Squeezy). You agree to their terms of service and privacy policy.
- All fees are stated in US Dollars unless otherwise indicated.
- You are responsible for all applicable taxes. Depending on your location, sales tax, VAT, or other taxes may apply.
13.3 Automatic Renewal
Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. The renewal fee will be the same as the current billing rate unless we provide advance notice of a price change.
13.4 Price Changes
We may change subscription prices at any time. If we change the price, we will provide at least 30 days' advance notice before the next billing cycle. Your continued use after the price change takes effect constitutes your agreement to pay the new price. If you do not agree, you must cancel before the new price takes effect.
13.5 Failed Payments
If a payment fails, we will attempt to process the payment again. If payment continues to fail, we may suspend or downgrade your account until payment is resolved. We are not liable for any data loss or service interruption resulting from failed payments.
13.6 Usage Limits
Each subscription plan includes specific usage limits (e.g., number of social accounts, posts per month, team members, storage). Exceeding these limits may result in service restrictions, automatic plan upgrades, or overage charges as described in your plan details.
14. Free Trial
- New Starter plan subscribers receive a 14-day trial period with access to Professional plan features.
- Payment information is required to start a trial. You will be charged the Starter plan fee upon sign-up.
- After the 14-day trial period, Professional features will be locked and your account will revert to Starter plan features.
- To retain Professional features after the trial, you must upgrade your subscription.
- We reserve the right to limit trials to one per individual or entity.
- We may modify or discontinue trial offers at any time without notice.
15. Refund Policy
- Monthly Plans: Monthly subscriptions are non-refundable. You may cancel at any time, and your access will continue until the end of the current billing period.
- Annual Plans: If you cancel an annual subscription within the first 14 days of purchase (and have not excessively used the Service), you may request a full refund. After 14 days, annual subscriptions are non-refundable, but you may continue to use the Service until the end of your annual billing period.
- Downgrade: If you downgrade your plan, the change will take effect at the start of your next billing cycle. No pro-rata refund is provided for the remainder of the current billing cycle.
- Exceptions: We may, at our sole discretion, provide refunds in exceptional circumstances (e.g., prolonged Service outages, billing errors). Contact billing@post-hive.com for refund requests.
16. Service Availability & SLA
- We strive to maintain high availability but do NOT guarantee 100% uptime.
- The Service may be temporarily unavailable due to scheduled maintenance (with reasonable advance notice), emergency maintenance, third-party service outages, force majeure events, or factors beyond our control.
- Scheduled posts may fail to publish due to social media platform outages, API changes, rate limiting, token expiration, or other factors beyond our control. PostHive is NOT liable for failed or delayed posts.
- We recommend maintaining your own backups of critical content and not relying solely on PostHive for content storage.
- Service level guarantees, if any, are described in the applicable subscription plan and are subject to the exclusions described herein.
17. Termination
17.1 Termination by You
You may cancel your subscription and delete your account at any time through your account settings or by contacting support@post-hive.com. Upon cancellation:
- Your access to paid features will continue until the end of your current billing period.
- You may request export of your data before account deletion.
- Account deletion will be processed within 30 days. During this period, you may request account restoration.
- After the 30-day grace period, your data will be permanently deleted in accordance with our data retention policy.
17.2 Termination by PostHive
We may suspend or terminate your account immediately, without prior notice or liability, if:
- You breach any provision of these Terms.
- You engage in fraudulent, abusive, or illegal activity.
- Your account is used for unauthorized purposes.
- Required by law or legal process.
- We discontinue the Service (with reasonable advance notice in this case).
17.3 Effects of Termination
Upon termination, all rights and licenses granted to you under these Terms will immediately cease. Sections that by their nature should survive termination will survive, including but not limited to: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.
18. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POSTHIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR VIRUS-FREE.
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SERVICE OR ANY CONTENT, ANALYTICS DATA, OR AI-GENERATED OUTPUT.
- WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
- WARRANTIES THAT SCHEDULED POSTS WILL BE PUBLISHED SUCCESSFULLY ON ANY THIRD-PARTY PLATFORM.
- WARRANTIES THAT ANALYTICS DATA OR REPORTS ARE ACCURATE OR COMPLETE.
- WARRANTIES THAT AI-GENERATED CONTENT IS ACCURATE, ORIGINAL, NON-INFRINGING, OR APPROPRIATE.
- WARRANTIES THAT THIRD-PARTY PLATFORMS WILL CONTINUE TO PROVIDE API ACCESS OR MAINTAIN THEIR CURRENT FUNCTIONALITY.
YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM POSTHIVE OR THROUGH THE SERVICE, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL POSTHIVE, INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AFFILIATES, SUBSIDIARIES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES.
- THIS LIMITATION APPLIES WHETHER THE DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT POSTHIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- IN NO EVENT SHALL POSTHIVE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO POSTHIVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
- POSTHIVE IS NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM: FAILED OR DELAYED SOCIAL MEDIA POSTS; SOCIAL MEDIA ACCOUNT SUSPENSIONS OR BANS; THIRD-PARTY PLATFORM API CHANGES OR OUTAGES; LOSS OF SOCIAL MEDIA FOLLOWERS OR ENGAGEMENT; INACCURATE ANALYTICS DATA; AI-GENERATED CONTENT THAT IS INACCURATE, DEFAMATORY, OR INFRINGING; EMAIL DELIVERY FAILURES; DATA LOSS; UNAUTHORIZED ACCESS TO YOUR ACCOUNT DUE TO YOUR FAILURE TO MAINTAIN ACCOUNT SECURITY; OR ANY ACTION TAKEN BY THIRD-PARTY PLATFORMS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
20. Indemnification
You agree to indemnify, defend, and hold harmless PostHive, Inc., its directors, officers, employees, agents, contractors, licensors, service providers, subcontractors, suppliers, and affiliates (collectively, the "PostHive Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service or any activity under your account.
- Your User Content, including any content published through the Service to third-party platforms.
- AI-generated content that you publish, distribute, or act upon.
- Your violation of these Terms or any applicable law, regulation, or third-party right.
- Your violation of any third-party social media platform's terms of service or policies.
- Any dispute between you and a third party (including social media platforms, email providers, or other users).
- Your negligence or willful misconduct.
PostHive reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.
21. Dispute Resolution & Arbitration
21.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@post-hive.com and attempt to resolve the dispute informally for at least 30 days.
21.2 Binding Arbitration
IF THE DISPUTE IS NOT RESOLVED INFORMALLY WITHIN 30 DAYS, YOU AND POSTHIVE AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) or JAMS, at the election of the claimant. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.
21.3 Class Action Waiver
YOU AND POSTHIVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and PostHive agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
21.4 Small Claims Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court for claims within the jurisdiction of that court.
21.5 Opt-Out of Arbitration
You may opt out of this arbitration clause by sending written notice to legal@post-hive.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts specified in Section 22.
22. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. If the arbitration clause does not apply (e.g., you opted out), you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes.
Notwithstanding the foregoing, PostHive may seek injunctive or other equitable relief in any court of competent jurisdiction worldwide to protect its intellectual property rights.
23. Force Majeure
PostHive shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond PostHive's reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, accidents, strikes, labor disputes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of telecommunications or internet infrastructure, power outages, third-party service provider outages (including social media platforms, cloud hosting, and payment processors), cyberattacks, DDoS attacks, government actions, or any other event beyond our reasonable control.
24. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations (EAR) maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control (OFAC), and the International Traffic in Arms Regulations (ITAR). You may not use the Service in or export the Service to any country, person, or entity that is subject to U.S. trade sanctions or embargoes.

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by PostHive. We do not endorse and are not responsible for the content, privacy policies, practices, availability, or security of any third-party websites or services. You acknowledge and agree that PostHive is not liable for any damage or loss caused by or in connection with use of or reliance on any third-party content, goods, or services.
Your interactions with third-party services (including but not limited to social media platforms, email providers, payment processors, and analytics providers) are governed by those third parties' terms of service and privacy policies. We encourage you to review those terms before using our integrations.
27. Beta Features
We may occasionally offer beta, preview, early access, or experimental features ("Beta Features"). Beta Features are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. By using Beta Features, you acknowledge and agree that:
- Beta Features may be unstable, incomplete, or contain bugs.
- Beta Features may be modified or discontinued at any time without notice.
- Data processed through Beta Features may be lost or corrupted.
- Beta Features should not be relied upon for production or critical business operations.
- PostHive has no liability for any issues arising from your use of Beta Features.
- We may collect additional usage data and feedback related to Beta Features to improve the Service.
28. API & Integration Terms
If you access the Service through our APIs or build integrations with PostHive, the following additional terms apply:
- You must comply with all API rate limits, usage restrictions, and documentation requirements.
- You must not use the API in ways that exceed reasonable request volumes or that could impair Service performance.
- API access may be revoked at any time for violations of these Terms or misuse.
- We may modify the API at any time with reasonable notice. We will endeavor to provide backward-compatible changes where possible.
- You must keep your API credentials secure and not share them with unauthorized parties.
- You are responsible for all activities conducted through your API credentials.
- Commercial redistribution or resale of PostHive API access requires our prior written consent.
28.1 Public API & API Keys
The PostHive Public API (accessible at /api/v1/) allows programmatic access to create, schedule, publish, and manage posts on your connected social media accounts. Access is authenticated via API keys that you generate from your account settings.
- Key Security: API keys are shown only once at creation. You are solely responsible for storing your keys securely. PostHive stores only a cryptographic hash of each key and cannot recover lost keys. If a key is compromised, you must revoke or rotate it immediately.
- Scopes & Permissions: Each API key is limited to the scopes you assign at creation (e.g.,
posts:read, posts:write, posts:publish). You should follow the principle of least privilege and only grant scopes that are necessary for your integration. - Rate Limits: Each key has configurable rate limits (per-hour, per-day, and burst). Exceeding your rate limits will result in
429 Too Many Requests responses. Default limits apply if you do not configure custom limits. - IP Restrictions: You may configure IP whitelists or blacklists per key. Requests from unauthorized IP addresses will be rejected with a
403 Forbidden response. - Webhooks: You may configure webhook URLs to receive real-time event notifications (e.g., post published, post failed). Webhook payloads are signed with HMAC-SHA256 using a shared secret. You are responsible for verifying webhook signatures and securing your webhook endpoints.
- Accountability: All actions performed via the API are attributed to your organization and count toward your plan limits (post quotas, scheduling limits, etc.) in the same way as actions performed through the web interface.
- Prohibited Use: You must not use the API to circumvent plan limits, automate spam or bulk unsolicited content, violate any connected platform's terms of service, or perform denial-of-service attacks against PostHive infrastructure.
29. Modifications to Terms
We reserve the right to modify these Terms at any time at our sole discretion. When we make changes:
- We will update the "Last Updated" date at the top of these Terms.
- For material changes, we will provide at least 30 days' notice via email and/or a prominent notice within the Service before the changes take effect.
- Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
- If you do not agree with the modified Terms, you must stop using the Service and may cancel your account.
We encourage you to review these Terms periodically.
30. General Provisions
30.1 Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices published by PostHive on the Service, constitute the entire agreement between you and PostHive concerning the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
30.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, such provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.
30.3 Waiver
No waiver by PostHive of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by PostHive to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
30.4 Assignment
You may not assign or transfer these Terms, or any of your rights or obligations hereunder, without our prior written consent. PostHive may freely assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. Subject to the foregoing, these Terms will be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
30.5 Notices
PostHive may provide notices to you via email to the address associated with your account, through in-app notifications, or by posting on the Service. Notices from you to PostHive must be sent to legal@post-hive.com.
30.6 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
30.7 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect.
30.8 Survival
The following sections shall survive any termination or expiration of these Terms: Intellectual Property (Section 11), Disclaimer of Warranties (Section 18), Limitation of Liability (Section 19), Indemnification (Section 20), Dispute Resolution (Section 21), Governing Law (Section 22), and General Provisions (Section 30).
